Tax credits are available for qualified solar water heating and photovoltaic systems. The credits are available for systems "placed in service" from January 1, 2006 through December 31, 2008. The tax credit is for 30% of the cost of the system, up to $2,000. This credit is not limited to the $500 home improvement cap.

Fuel Cells

There is a consumer tax credit of up to 30% of the cost (up to $500 per 0.5 kW of capacity maximum) for installing a “qualified” fuel cell and microturbine systems. The credits are available for systems “placed in service” from January 1, 2006 through December 31, 2007. This credit is not limited to the $500 home improvement cap.

Federal incentives for commercial buildings are driving cool roof technology, innovations in building automation systems, architectural green building design, and new materials that insulate, reflect heat, and offer fast pay back through energy savings.  Federal Energy Policy Act deductions for energy savings have incentivised thousands of commercial buildings to upgrade inefficient office and warehouse lighting.New 2007 Energy legislation drives higher mpg CAFE standards for cars, requires federal buildings to be green and targets a range of special program developments in everything from biofuels to small busines telecommuting in an effort to save energy.

Currently legislation is on the table to re-authorize home solar credits and extend many of the existing energy deductions and credits that are due to expire this year.  All indications are that these good ideas willnot only help stimulate the economy and create jobs but will continue the positiove energy conservation trend we have entered upon.

Known officially as the Renewable Fuels, Consumer Protection, and Energy Efficiency Act of 2007,
it introduces the first increase in mileage standards since 1975, when mandates were first instituted.
It calls for ethanol production--both from corn and other sources, such as woodchips and switchgrass--to increase nearly fivefold over the next 15 years. And it sets higher standards for efficiency of lighting and household appliances, with a goal of phasing out incandescent bulbs in 10 years.

Tax Credits for Home Builders:
Eligible contractors need to fill out IRS Form 8908   to get the tax credit. The IRS has provided the following guidance regarding the tax credits for constructing energy efficient new homes available under the Energy Policy Act of 2005:
  • IRS Notice 2006–27   provides guidance for the credit for building energy efficient homes other than manufactured homes.
  • IRS Notice 2006–28   provides guidance for the credit for building energy efficient manufactured homes.

The tax credit information provided below is based on information contained in the Energy Policy Act of 2005. The IRS guidance provides specific information that home builders and housing manufacturers can rely on to take action to claim the tax credits. ENERGY STAR will study the IRS publications and provide updates as necessary.

ENERGY SAVING At The Office
Home builders are eligible for a $2,000 tax credit for a new energy efficient home that achieves 50% energy savings for heating and cooling over the 2004 International Energy Conservation Code (IECC) and supplements. At least 1/5 of the energy savings must come from building envelope improvements. This credit also applies to contractors of manufactured homes conforming to Federal Manufactured Home Construction and Safety Standards.

There is also a $1,000 tax credit to the producer of a new manufactured home achieving 30% energy savings for heating and cooling over the 2004 IECC and supplements (at least 1/3 of the savings must come from building envelope improvements), or a manufactured home meeting the requirements established by EPA under the ENERGY STAR program.

Please note that, with the exception of the tax credit for an ENERGY STAR qualified manufactured home, these tax credits are not directly linked to ENERGY STAR. Therefore, a builder of an ENERGY STAR qualified home may be eligible for a tax credit but it is not guaranteed.

These tax credits apply to new homes located in the United States whose construction is substantially completed after August 8, 2005 and that are acquired from the eligible contractor for use as a residence from January 1, 2006 through December 31, 2008.

Production Tax Credit Extension For Large Wind Turbines

Under present law, an income tax credit is allowed for the production of electricity from qualified wind energy facilities and other sources of renewable energy. The current value of the credit is 2 cents/kilowatt-hour of electricity produced. The credit was created under the Energy Policy Act of 1992 (at the value of 1.5 cents/kilowatt-hour, which has since been adjusted annually for inflation) and applies to electricity produced by a qualified wind facility placed in service after December 31, 1992, and before January 1, 2009. The production tax credit (PTC) is only applicable to utility-scale wind turbines, not smaller turbines used to power individual homes or businesses.

Now On To The Senate

The latest energy bill, HR5351 features extension of production tax credits and other measures for renewable energy sources such as solar, biofuels and wind energy. Projected to cost 18 billion over ten years, the measure also targets the freezing of manufacturing tax incentives for the five largest oil companies, which Democrats argue they don't need in light of the highest profits ever reported by any corporation in history. Heated debate was fueled by a Republican effort to tie terrorism surveilance legislation to domestic energy issues which wasted discussion time on the floor.

Democrats may have put renewable energy issues at risk by linking and targeting benefits to the oil companies in this legislaton as big oil will no-doubt mobilize all of their political resources to fight vigorously.

It is the opinion of this author that this bill will provide much needed economic stimulus in the contracting and building industries especially for commercial buildings, arguably the largest energy users, and residential energy efficiency projects. Additional tax credits will tip the scales in favor of large retrofit projects, small business solar, wind and bio-fuel start ups and the generation of all those new green jobs this economy needs so badly. Extension of Energy Policy act of 2005 Commercial buildings tax deductions should also be increased and extended with the senate legislation to continue support for energy efficiencies that have been working well for lighting, HVAC and Building Envelope initiatives.

To date, Democrat sponsored energy legislation has had a hard time passing in the Senate, failing by only a few votes.  With a promised Presidential veto this energy bill will have a hard time making it through to final passage. Perhaps the answer is to bundle the elimination oil company tax incentives with limited drilling approval in Anwar, with benchmark environmental protections and guarantees from domestic oil.  Like it or not, oil is still at the heart of our energy use here in the USA and we will need all we can get in the short term, until renewables and clean energy alternatives come on line in a bigger way.

Congress Tries Again To Pass New Solar Credits
When solar credits were left out of the December energy bill, both House Speaker Nancy Pelosi and Senate Majority Leader Harry Reid vowed to reintroduce them in early 2008. Earlier this month, Congress once again left solar credits out of its broad economic stimulus package, leading House leaders to decide to attempt a stand-alone bill.The legislation, which would result in approximately $18.0 billion in lost taxes over 10 years, is designed to tap additional revenue from the oil and gas industry to offset that, which President Bush opposes. The president's veto threat effectively killed the December attempt to fold the credits into the energy bill.  Read More..

The Home Improvements tax credit has expired. The credits were available for home improvements "placed in service" from January 1, 2006 through December 31, 2007. You have until April 15, 2008 to claim credit on your 2007 taxes for any qualified home improvements made to your primary residence during 2007. If you made any qualified home improvements in 2006, but did not claim them on your 2006 taxes, you will need to file an amended return. You can not claim credit on your 2007 taxes for improvements made in 2006. Tax credits were available for insulation, replacement windows, water heaters, and certain high efficiency heating and cooling equipment. The maximum amount of homeowner credit for all improvements combined is $500 during the two year period of the tax credit.

If you are building a new home, you do not qualify for the tax credits for "eligible building envelope components" (windows, doors, insulation, roofs) or "qualified energy property" (HVAC & non-solar water heaters). However, the tax credit for photovoltaics, solar water heating, and fuel cells is available for homeowners building new homes. The Internal Revenue Service (IRS) guidance for consumers:

Tax credits are available to buyers of hybrid gasoline-electric, diesel, battery-electric, alternative fuel, and fuel cell vehicles. The tax credit amount is based on a formula determined by vehicle weight, technology, and fuel economy compared to base year models. These credits are available for vehicles placed in service starting January 1, 2006. For hybrid and diesel vehicles made by each manufacturer, the credit will be phased out over 15 months starting after that manufacturer has sold 60,000 eligible vehicles. For vehicles made by manufacturers that have not reached the end of the phase-out, the credits will end for vehicles placed in service after December 31, 2010.
